Linda Kincaid Reports: Shameful abuse of Gary Harvey: Disabled veteran in Chemung County, New York

March 13, 2013

Gary Harvey received a special treat for his birthday on February 27, 2013. On that day, and only on that day, Gary’s wife was allowed to kiss Gary on the cheek two times. Gary’s wife was also allowed to hold his hand for five minutes.

Gary is not a criminal. Neither is his wife, Sara Harvey. Gary is a disabled adult.

In 2006, Gary suffered a head injury that left him in a vegetative state. Gary is completely dependent on caregivers for all of his care. Gary’s wife, Sara, was by his side at the facility for months. Sara became trained on Gary’s care and made arrangements to bring him home.

In 2007, the Chemung County Court placed the Public Guardian in control of Gary’s life. In a story familiar to many victims of the court system, false allegations were made against Sara. Lacking the legal savvy to navigate a hostile court environment, Sara lost all voice in Gary’s care.

Gary Harvey of “warehoused scenario central”, New York, is living in an inexcusable isolation! What visits this man is allowed are limited, restricted and supervised. Permission must be obtained to even touch him. A kiss on the cheek must also be approved by the authority now deemed in control of his very existence. An authority that seems to enjoy toying with the lives and emotions of those they can control and the friends and loved ones that have dared to challenge or question their decisions, behaviors and directives.

Chemung County, New York, supposedly cares for its wards, even the ones they claim not to want, but then fight desperately to keep. Their decisions are always in the best interest of those wards, right? (That’s what they say anyway.) This then makes one wonder why they would hesitate to make sure the eye care that Gary Harvey gets is top-notch (they certainly aren’t paying for it) and to stay on top of what might be an eye problem in the making or a condition getting worse.

Gary Harvey suffers from a traumatic brain injury. That’s true. However, no one knows how far he could come along, if he were to receive therapy and stimulation, such as having frequent visitors who are allowed to touch him and give him a kiss on the cheek, just because giving him a kiss on the cheek might be a gesture of affection he is needing. No one knows and it seems like those in control — simply don’t care.

Chemung county continues persecuting Sara and Gary Harvey

March 2, 2013

It seems the tortured imprisonment of Gary Harvey in Chemung County New York, will never end. Mr. Harvey who suffered a head injury as a result of a fall in his home seven years ago, has been a real cash cow for not only the hospital he is confined to, but also for numerous agencies, attorneys and predatory guardians. As long as Mr. Harvey can be owned and controlled by the predators, his safety, welfare and general overall health will continue to deteriorate. But there is money to be made! And Mr. Harvey has been a virtual ATM for those who continue to hold him hostage.

Mr. Harvey has been billed more than 1 million a year in medical and rehabilitation costs billed to his wife’s insurance. Much of this was for rehabilitation services that never occurred. State agencies and agents are availing themselves of Mr. Harvey’s social security checks, and any funds supplied by the Veterans Administration along with Medicaid funds. You can see it is not in the financial interests of the predators involved to release Gary from his imprisonment.

To understand just how vindictive, how callous and vicious these individuals can be, please note the letter received shown below. Keep in mind this is Sara Harvey’s husband who is being abused here, and this letter is in regards to his birthday visit from his wife:

RE: Gary visitation
Deretha Watterson, LCSW-R Kellie Lowman

Commissioner Children and Family Services

During Gary’s visit today, 2/27/13, Sara Harvey is permitted the following actions:

  • Kiss Gary two times on the cheek

  • Hold hand under the following conditions:

  • Hands are visible at all times by the monitor (CIS staff person and camera).

  • Sara’s hand should NOT be moving at all when holding Gary’s hand.

Please note that the above two actions shall only be permitted under the above conditions. IF Sara deviates at any time during today’s visit from these stated expectations, then all touching should stop immediately.

These permitted actions cease at the end of the visit today.

********************************************************************

Mrs. Harvey has waged a never-ending battle to not only free her husband from this horrendous abuse, but most times just to have access to her husband. Visitation occurs only under the supervision of an armed guard and a nurse. Most times she is not allowed to touch him or comfort him in any way. She is not allowed to take pictures of him in his chronically deteriorating condition to document the abuse and neglect this man has suffered at the hands of predators who operate under the protection and facilitation of the probate courts.

Schiavo Brother Tries to Save Another Life

January 15, 2013

It is very scary when a state wants to dehydrate a citizen. That happened several years ago in the Haleigh Poutre case in Massachusetts. Haleigh was a 12-year-old child abuse victim beaten viciously by her step father into unconsciousness. Within days of her injury, doctors said she would never awaken and the state immediately sought court approval to dehydrate her to death. Luckily for Haleigh, the bureaucratic requirements took enough time for her to prove her doctors dead wrong by awakening. Today, she is moving on with her life–no thanks to the state social workers who advocated for her death rather than her life until she became clearly conscious.

In New York, a court has removed a wife from guardianship of her apparently unconscious husband, and the court appointed guardian wants him dehydrated to death on advice of doctors. Terri Schiavo’s brother, Bobby Schindler, has stepped in and asked to be named guardian. From The Leader story:

In 2007, Sara Harvey was removed as her husband’s guardian when a judge ruled she was ill-suited to care for him and did not follow the advice of medical professionals. The county was named Gary Harvey’s guardian. In 2009, Chemung County planned to remove Gary Harvey’s feeding tube on the advice of doctors, but the move was blocked. A do-not-resuscitate order remains in place. Later in 2009, Schindler joined Sara Harvey’s cause, saying she had the right to regain guardianship of her husband and take him home to care for him there.
After filing his guardianship request, Schindler said: “I have raised the question many times, ‘How can Chemung County, guardian of Mr. Harvey, be acting in his best interest when they, in fact, tried to kill him?’ From all indications, it appears that Mr. Harvey has been warehoused and denied the opportunity to receive the care and rehabilitative services that would benefit his condition.”

I have seen cases where guardianship was removed solely because the family member wouldn’t agree to dehydrate. I don’t know if that is the case here. But even if she is unable to personally provide his care, that doesn’t mean her opinion about her husband’s continuing existence should be disregarded. As Bobby Schindler told me:

How ironic. When my sister’s husband wanted her dehydrated, we were told that spouses should decide. Now, when the spouse doesn’t want him dehydrated, her opinion apparently doesn’t matter.

Go, Bobby! Go!

Schiavo’s brother seeks guardianship in local case

January 14, 2013

ELMIRA — The brother of Terri Schiavo, whose right-to-die battle played out in the public spotlight in the early 2000s, has asked New York’s Supreme Court to name him the guardian of a Chemung County man who has been in a persistent vegetative state for nearly seven years.

Bobby Schindler is petitioning the court to name him the legal guardian of Gary Harvey, who was living in Horseheads in 2006 when he fell down his basement steps and suffered a traumatic brain injury. Since the accident, Harvey has been in a persistent vegetative state.

Harvey’s wife, Sara Harvey, has been involved in a prolonged legal battle with the county regarding the care of her husband, who did not have a living will at the time of his accident.

A court date is set for Jan. 30.

Schindler is the executive director of the Terri Schiavo Life & Hope Network, an organization that works to protect the rights of the medically vulnerable.

Like Gary Harvey, Schiavo did not have a living will when she fell into a persistent vegetative state in 1990. Her guardian, husband Michael Schiavo, eventually decided to have her feeding tube removed, but Terri Schiavo’s parents and brother strongly opposed.

After years of bitter legal battles, Terri Schiavo’s feeding tube was removed. She died March 31, 2005, in Florida.

Case continues involving guardianship of brain-injured man

January 9, 2013

Motions will be argued later this month as part of a Horseheads woman’s legal fight to end Chemung County’s guardianship of her brain-injured husband.

Bobby Schindler, the brother of Terri Schiavo, is petitioning to serve as guardian for Gary Harvey, according to the Terri Schiavo Life and Hope Network, of which Schindler is executive director.

Motions are scheduled to be argued beginning at 9:30 a.m. Jan. 30 before state Supreme Court Judge Judith O’Shea, the Chemung County Court Clerk’s Office confirmed.

Harvey suffered a traumatic brain injury following a heart attack and subsequent fall down a flight of stairs in January 2006 and remains in a persistent vegetative state.

His wife, Sara Harvey, sought guardianship of her husband, but the county Department of Social Services was appointed as his legal guardian indefinitely.

Sara Harvey has said that her husband has suffered under significantly inadequate care and has fought in state Supreme Court for guardianship.

Attorney Christopher Johnson filed Schindler’s petition, the county clerk’s office confirmed.

Mary Schindler, Schiavo’s mother, was a Corning native and graduated in 1959 from Northside High School in Corning. Her maternal grandparents, the late Mike and Cecilia Tammaro, also lived in Corning, where Mike Tammaro managed Keenan’s Rexall drug store.

Schiavo, who was diagnosed as being in a persistent vegetative state, was at the center of a series of legal challenges that resulted in a seven-year delay before her life support was terminated in 2005.

Schindler’s list: Terri’s brother now saving others

January 4, 2013

Bobby Schindler, the brother of Terri Schiavo and the executive director of the foundation that bears his sister’s name, is seeking to be appointed guardian for a New York man who was left with a severe brain injury after a home accident.

The announcement was made by the Terri Schiavo Life & Hope Network, which confirmed that attorney Christopher Johnson has filed with the Supreme Court for New York a petition seeking Schindler’s appointment.

At issue is the health and future for Gary Harvey, a Chemung County resident who was injured in a home accident in 2006.

The accident left Harvey with a profound brain injury, and his spouse, Sara Harvey, sought guardianship, only to be rejected by the Chemung County Supreme Court. The court eventually appointed the county department of social services.

According to the foundation, Sara Harvey has been fighting the county in court ever since. So far, however, courts have kept the county in charge of Harvey’s case, even though an ethics committee from the hospital where Harvey was staying recommended that he be deprived of food and liquid, which essentially would kill him.

While the foundation says the court rejected that request, it has continued to rule that county officials are in charge of Harvey’s life.

“I have raised the question many times, ‘How can Chemung County, guardian of Mr. Harvey, be acting in his best interest when they, in fact, tried to kill him?’ From all indications, it appears that Mr. Harvey has been warehoused and denied the opportunity to receive the care and rehabilitative services that would benefit his condition,” stated Bobby Schindler.

Bobby Schindler Files Petition Requesting to be Gary Harvey’s Guardian

December 31, 2012

Bobby Schindler, brother of the late Terri Schiavo, has filed a petition in the New York Supreme CourtChemung County asking guardianship of Gary Harvey be turned over to him. How can the County refuse to resign or disagree with the petition? How could they dare say this guardianship transfer would not be in the best interest of Gary Harvey? Legitimately, they can’t.

Should the County fight Bobby Schindler’s effort, then the County (and those involved in the case on their side), shall have been proven to have lied to the court and the community. The County claimed it did not want to be Gary’s guardian, but there was no one else. Now there is. So, if they fight to retain guardianship, that means there is an ulterior motive for doing so. After all, just why would they fight so desperately to retain a ward they didn’t want in the first place or thereafter; have warehoused; and, seem to think is bothersome and time consuming in the isolation and hide the information (from his wife) health care plan they have prepared for him?

Bobby Schindler has an impeccable reputation. He is knowledgeable about TBI (traumatic brain injury). He has first-hand experience in dealing with a family member suffering from TBI. He is compassionate and caring. He is hopeful and realistic. Just what part of all that he is, could the County honestly say is not good enough to be guardian of Gary Harvey? Can we say – none?

The Dictators of Non-Compassion: Gary Harvey Case and the Unexpected Twist

Sara & Gary Harvey

How long has it been since Gary Harvey fell down those basement stairs? Some days it seems as though it was only yesterday, but it wasn’t. It was January 21, 2006. It has been nearly seven years and little has changed, since the county took over and began their reign of merciless dictatorship.

Oh, Gary & Sara Harvey have gotten seven years older and he is no longer in the nursing home, but a ward connected to St. Joseph Hospital. Only his location has changed, as the desperate and uncalled for battle goes on with the power hungry feeding upon, demeaning, and controlling this husband and wife.

On December 10, 2010, I wrote:

Amazing! I can actually recycle my article as if it was current and remaining accurate. How often does that happen?

Here it is the holiday season of 2010 and Sara Harvey gets a letter from Bryan Maggs, Chemung County Attorney, stating that her visitations with Gary are suspended immediately. Isn’€™t that the same gift they offered last year? I’€™m so impressed with the repeat gift and the timing –” NOT! (Wife’€™s Visitation in Jeopardy: The Recycling of Gary Harvey’€™s Holiday Restrictions)

Would anyone be surprised to learn that Sara didn’t get to visit Gary on Christmas Day 2012?

It isn’t often that one can continue to recycle articles and pretty much be assured that there is going to be some excuse… some mistake… some problem raising it’s ugly little head and taking away anything that could be considered special for Gary and Sara, especially during this special holiday season. It isn’t often, unless the articles happen to involve Gary and Sara Harvey, Chemung County and St. Joseph Hospital.

Anyone see a pattern?

Where has Kevin Moshier been? Silent once again?

Guardianships are like adoptions in that it is the obligation of the guardian to look out for the ward he has been put in charge of. Unlike adoptions, the guardian is supposed to act on behalf of the ward and make decisions as the ward would make for self if capable. And then there is the attorney to insure the rights of the ward. So, where has Kevin Moshier (the appointed attorney) been when Gary Harvey’€™s wishes have been trampled upon?

As I reported in the past, “€œGary Harvey is the brain injured man from New York, who seems to have his own private “€œdeath panel”€ determined to kill him off and to make his and his wife’€™s life as miserable as possible, ‘until the sentence is carried out. One might think it could get no worse than it has been. One should never think such thoughts, lest one (or more) be shown that –€” for however bad –” things can actually get worse!

Just where was Kevin Moshier, the attorney who should be representing Gary against any wrongs, when the so-called ethic’€™s committee wanted to put Gary down by starving and dehydrating him to death? Did he stand strong and ask what these people were thinking and why they would even consider such a thing?

When they put the DNR on Gary, did Kevin Moshier demand they lift it?

When Sara Harvey’€™s visits with her husband were restricted, did Kevin Moshier step up to the plate and say, “€œI don’€™t think so. This is not what Gary would want. This is not in Gary’€™s best interest. Gary has a right to have time with his wife.”€ Did he? Of course he didn’€™t.

Sara is a danger to Gary? I didn’€™t even go to law school and I can see that the case against Sara is trumped up and so full of holes that even a pre-med student could dissect it in a few moments. But Kevin Moshier couldn’€™t or can’€™t?

Even more amazing is the fact that it was the guardian & pals that tried to kill off Gary, with Moshier quietly hanging out, though it was Sara who was, and has been, labeled the danger. (I have trouble getting my reality oriented thoughts around that one.)

What about the press conference where information was given about Gary Harvey’€™s case that should not have been given? Information that I believe was to turn people on Gary. Did Kevin Moshier do anything about that? Did he file on those responsible? ~ (August 5, 2011) The Silence of Kevin Moshier

Gary’s life is in the hands of these county vultures. Yes, the very group of people who attempted to have their ward starved and dehydrated to death, claiming he was terminally ill. Oh, but it is Sara that they treat and report as the threat? The irony is beyond belief. However, these people have not fooled everyone, nor have they covered their tracks as well as perhaps they think. The day will come when they answer to the one they can hide nothing from. It will be a day their cold hearts shall be placed in judgment and every cruel thought and action shall be reviewed.

Gary Harvey does not need to be under the guardianship of the County. He is their ward due to half-truths, non-truths, attorneys backing out at the last minute, attorneys not doing the job but taking the money and things such as that. They think we don’t know all this, but many of us do.
